1. Preamble and definitions
These Terms and Conditions govern access to and use of ArtReflect, edited and operated by Benjamin Bourdieu, who can be contacted at [email protected].
Accessing the service implies full acceptance of these terms. If you do not accept them, you must stop using the service.
Definitions: “Service” means the ArtReflect web application and its features. “User” means any individual with an account. “Content” means any image, data or note uploaded by the User.
2. Service description
ArtReflect is a studio tool for painters. It analyses a reference photo, generates work views, tracks progress photos and visually compares a painting in progress with the reference.
The service is available through a web browser. The editor may evolve, add or remove features without prior notice.
3. Rights over images and content
The editor claims no ownership over images or content uploaded by the User. You remain the sole rights holder for your files.
3.1 Ownership of uploaded images
Reference photos and progress photos uploaded to ArtReflect remain your exclusive property. You only grant a limited technical licence required to operate the service: storage, image processing and display.
3.2 Images generated by the service
Work views produced by ArtReflect from your images belong to you and may be used freely, including for commercial purposes.
3.3 Responsibility for third-party rights
You are solely responsible for ensuring that you have the necessary rights over the images you upload.
3.4 No AI training
Your images are never used to train artificial intelligence models. Image processing is algorithmic and involves no machine learning on your data.
3.5 Data isolation between users
Your projects, images and analyses are private. No other user has access to your content.
3.6 Image deletion
Deleting a project or progress photo permanently deletes the associated files from our servers. This deletion is irreversible.
4. Personal data (GDPR)
The editor collects the data required for the service: email address, hashed password, uploaded images, analyses and project notes.
This data is processed for contract performance. It is not shared with third parties for commercial purposes.
Under GDPR, you have rights of access, rectification, deletion, portability and objection. To exercise these rights, contact [email protected].
Data is hosted in Europe and retained for the active lifetime of your account, plus 30 days after closure.
5. Subscription and payment
Full access to the service requires a paid subscription. Current prices are displayed on the service homepage.
Payment is handled by Stripe. The editor stores no banking data. The subscription renews automatically at each term unless cancelled by the User.
You have 14 days from subscription to exercise your withdrawal right, unless you expressly requested immediate access to the service.
6. Limitation of liability
The service is provided as is. The editor undertakes to maintain reasonable availability but does not guarantee uninterrupted availability.
The editor cannot be held liable for data loss caused by technical failure, accidental deletion by the User or force majeure.
The editor’s liability is limited to the amounts actually paid by the User during the 12 months preceding the damage.
7. Termination
The User may cancel their subscription at any time from the My account page. Cancellation takes effect at the end of the current billing period.
The User may request full deletion of their account and data at [email protected]. This deletion is final.
The editor may suspend or close an account in case of a serious breach of these terms.
